MESSAGE FROM THE RECREATIONAL BOATING ASSOCIATION OF WASHINGTON If you've been watching the local news lately, you've heard that new restrictions are being considered to keep the Northwest's whale population from allegedly being harmed by boaters, fishermen, kayakers and whale-watching tourists. Representatives of these groups have turned out in force to oppose a federal NOAA plan to protect killer whales by closing off 6.2 square miles of water off San Juan Island each year. RBAW has been attending these regional Northwest meetings, along with other marine interests in crowded rooms. The results have been mostly protests against NOAA's proposed half mile wide "no-go zone" on the west side of San Juan from May 1 through Sept. when the whales are typically present. The regulations would also prohibit boats from coming within 200 yards - twice the current limit - of the whales and being in the path of any killer whale within 400 yards. NOAA says the regulations are needed to protect the area's Southern Resident killer whales, declared endangered in 2005. They say boat traffic causes behavioral changes in whales, reduces their ability to communicate, risks vessel strikes, and impedes their ability to hunt for food. However meeting attendees in different Northwest forums have spoken out against the proposed rules saying they are based on faulty science, and that better enforcement of existing laws is all that is needed. Speakers have been almost universally opposed to the no go zone proposal saying there is little evidence to demonstrate that boats are harming the Orca population. Fishers and boaters are trying to set the record straight by explaining to NOAA that the likelihoods of a whale being struck by a boat is slim, trolling fisherman and kayakers are going too slow to pose a risk from excess noise or strike, and there is no evidence of past whale collisions to suggest these extreme rules are needed. People are arguing with NOAA saying their data and science is extremely flawed and most facets of the boating world oppose it. NOAA has been tasked to review their data and talk to people who are out there every day. To complicate NOAA's position, they have exempted government vessels and Tribal fisherman from the proposed no-go zone, but they would otherwise apply to all boats, including canoes and kayaks. Even conversationalists are against the proposal. The plan is feared to devastate the whale watching industry, sport fishing charters, kayak rental companies, and place a hardship on recreational boaters and fishers. RBAW's View: We agree that saving the Orca whales is necessary and worth doing. We however are unanimously opposed to the regulations and restrictions being proposed by NOAA. We see the scientific data presented to be limited in quantity and content in support of the conclusions presented. Broader vetting of the presented data needs to be accomplished by impartial scientific panels to validate the scientific data collected to date. We are also concerned if NOAA is successful here, how many other areas will they close off to boaters? WE ARE ADVISING OUR MEMBERSHIP AND BOATERS TO SEND THEIR E-MAIL COMMENTS TO NOAA. July 7, 2009 - The idea of the Environmental Protection Agency (EPA) allowing the introduction of a fuel that has never been independently tested for use with marine engines has Boat Owners Association of The United States (BoatU.S. and the National Marine Manufacturers Association (www.BoatUS.com/news/reports urging every boater in America to speak out on the issue before the July 20 federal comment period closes. In March, Growth Energy, a pro-ethanol lobbying organization, and 54 ethanol producers petitioned the EPA to allow an increase in the amount of ethanol in gasoline from 10 percent (E10) to 15 percent (E15). After an initial comment period that drew nearly 30,000 comments from concerned boaters, the marine industry, marina operators and many other boating groups, the agency extended the comment deadline to July 20. BoatU.S. and the NMMA are concerned because boat engines are not designed, calibrated or certified for use with gasoline containing more than 10 percent ethanol. Recreational boat warranty documents and manufacturers owner's manuals currently advise boaters not to use gasoline containing more than 10 percent ethanol, and therefore, the use of E15 in marine engines could void engine warranties and damage motors and fuel systems. "This is not about growing renewable energy," says BoatU.S. Vice President of Government Affairs Margaret Podlich. "This is really about a group of investors attempting to profit at the expense of 13 million recreational boat owners. We had significant problems with the nationwide roll-out of E10 a few years ago, and without further independent testing of E15 with marine engines we are very likely to see similar issues." Podlich is referring to the widely known problems with ethanol's ability to attract water into gasoline or "phase separate" which has led to boat engine failures and major repair or replacement costs for boaters. It also degrades fiberglass boat gas tank walls. If the ethanol lobby's petition is approved it would also affect other gasoline powered products. "There are an estimated 500 million gasoline powered engines in the U.S., from boats and autos to chainsaws, lawn mowers and ATVs, so this issue not only severely impacts the recreational boating industry but many others as well," said NMMA Legislative Director Mathew Dunn. "We have a very simple position on this matter. Science -- not politics -- should ultimately determine EPA's decision on whether to allow the sale of any increased ethanol blend that's more than 10 percent. At present, it is clear there is insufficient scientific and technical data to justify granting the increase, and EPA should therefore deny it outright," he added. Kevin McStay was on hand and conducted detailed video interviews, thus capturing stories and memories for historical reference to be preserved for years to come. Several brought scrapbooks of fun times growing up at BYC. Sharon Leedy brought a slide show of over 120 pictures she had preserved from her childhood times at BYC. One of her was as a bathing beauty on the foredeck of her parents boat, the "Sharon Lee". Brother, Lewis, was great at remembering places and events in the pictures. Dick Stevenson brought a layout of photos from cruises in the 50's on his parents boat, the "Zephyr". Norm Smith had a beautiful name board from his folks' boat the "Betsy Too" and BYC annuals from 1950-79. Roger Phillips displayed a beautifully made model of his folks' boat "Sea Spray" along with photos of him and his sister, Sharon, as BYC brats. The date is TUESDAY JUNE 16th!!! This will be an all day trip! We have contracted to get a 31 passenger bus, driven by dedicated driver P/C Lorrin Walsh. With a full bus, we should be able to do the trip for about $30 each. We are hoping to visit 4 (four) great wineries. Of course, we will have snacks and treats along the way and time out for lunch. TYC basin, 50 of those
were in the parade along with plenty fun and a nice sunny day for the
parade. The decorated entry for BYC was Misty Rose II. Chaired by Donna
Park skippered by the V/C with great help from : Mike & Sharron Leedy,
Gary & Jo Carr, Comm Mike & Abbie Dunn and Mike Ryan. I also want to
thank R/C John & Denise Rosendale, Leo & Stacy Longenecker, Darin &
Nancy Haustveit and Jim Minard for joining in for the parade. All were
given a BYC baseball jersey, ball caps and handed noise makers to help
cheer the R/C during Trivia.. Next year's theme will be "Carrousel into
Spring".

Do you own a recreational Vehicle? Class A, Class C, a Trailer, or a 5th wheel? If so mark this date on your calendar April 28th. P/C Lorrin Walsh will be showing his DVD "Drive Your Motorhome Like A Pro". Followed by a Power Point presentation, ending with a question and answer time. P/C Walsh's DVD will go over motor home driving techniques needed to become safer and more confident driver. From tips from commercial drivers, information on towing, all in basic layman term information. The DVD goes over basic rules so you can apply them to any vehicle you may drive. Lorrin has been driving tour bus/RVs for several years and has lots of information to share. This evening is for everyone who has an RV or who might be thinking about getting one. Lorrin says it is especially great for the co-pilot who is afraid to drive. The evening will start at 6:00PM, with a potluck dinner (bring your favorite dish to share) drinks and dessert will be provided by Bachman's for a small fee of $2. Please sign up at the club. Opening DayJo and Gary Carr would like your assistance during a Float Design meeting at BYC Clubhouse on Wednesday, March 25th at 6:30 PM. I will provide some "Adult Beverages" and snacks. Some preliminary ideas for the Float design have been discussed, but not finalized. Please come and offer your ideas and comments to finalize the design of the Float. Once the design issue is settled, your additional input and "helping hands" would be much appreciated in getting the Float built and transported to QCYC for mounting onto Seadragon for the parade. Come one, come all! The Fleet Captain will also appreciate your providing boat information to him if you will be taking it to QCYC, so he can arrange for BYC's moorage needs. Opening Day is one of our bigger Events, and we look forward to a large turnout, the Top Prize for Decorated boats, and a "Whale of a Good Time".

RBAW - Report (March 2009)As we travel north this summer we may need to think ahead about what documents we need to enter Canada and re-enter the US. Because the rules are lengthy and there are several ways to apply these rules I will be posting a hand out in the BYC lounge by May 1st. It will include information on the use of I-68, the NEXUS pass, the Enhanced Drivers license, and BR numbers, just to name a few. But…one of the rules that may apply to those staying in Canadian waters longer than 45 consecutive days is the need for everyone on the boat over the age of 18 to have a US Boaters Education Card. This card can be issued to you if you have already taken and completed a US Coast Guard Aux. or US Power Squadron course in boaters safety. Think back, you may have taken the course several years ago, at the time of your completion of the class you got a certificate, if you make a copy of this and send the copy in with an application, and $10, you will be issued a card. Applications can be downloaded from WWW.PARKS.WA.GOV/BOATING.ASP From the information I have it says if you were born before 1983 you do not need the card, but I have conflicting information, so for a $10 fee pp it is best to be prepared. Lastly, if you think you might be going in to Canadian waters and your yacht is 30' or longer you will need to get a 2009 Custom's Decal to re-enter the US. You can apply for the decal ($27.50) by going to www.cbp.gov click on travel, then click on Pleasure Boats and Private Flyers, then "User Fee Decals and Transponders" or call 1- 317-298-1245. I will make copies of as many applications, permits, etc and have them available at the club by May 1st.

Recreational Boating Association of Washington Feb. 23, 2009 Olympia, WA RBAW Monday Morning Update With the legislative session forty percent done, things are generally looking good for boaters- other than the budget. Our major legislation- the Boating Services and Safety Improvement Act of 2009 (SSB 5691/HB 2237) are out of the policy committees unanimously and in the budget committees for hearings- and our bill eliminating the quadrennial survey and setting the boater's share of the gas tax in statute at one percent is in House Rules awaiting floor action. The "boat lift" bill- SHB 1750- also came out of committee on Friday, and the derelict vessel amnesty pilot project- SSB 5058- is in Senate Rules. The aquatic lands marina lesase rates legislation remains troublesome. In the Senate, SSB 5255 is in a form that is completely objectionable, although it was moved forward as a vehicle for discussions. It continues to mandate an averaging of lease`rates, and so broadly defines "marina" it includes everything where one can tie up a boat (except exempt residential docks). In the House, the marina definition is not a problem, and the approach is to set lease rates as a percentage of income. The budget crisis remains the biggest threat to boating. With the problem now acknowledged to be over $8 billion, State Parks has been asked to prepare an additional cut of almost $13 million, on top of the $10 million cut in the Governor's budget proposal. The possibility of mothballing additional state parks- 27 more, for a total of 42 transferred, closed, or mothballed- looms. We'll update you next Monday morning. Here it is March 15th, the last weekend of Winter, and I look out onto some 3 inches of new snow. Abbie and I drove to the St. Patrick's Day Cruise-In to Poulsbo on
Saturday to visit with the 10 or so hardy BYC Boaters moored there (including a drive up visit by our VC and wife), while Abbie proceeded to cook up the traditional
"Corned Beef and Cabbage" dinner in the Marina meeting room. Later, we had to continue on to the Edmonds Commodore Ball, so we missed out on enjoying the Corned Beef. We
